Terms of Service
The agreement between you and Ashayam Group when you use ASMI.AI.
1. Acceptance
By accessing or using ASMI.AI (the “Service”), including the WhatsApp surface, the dashboard at app.asmi.live, or any related interface, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
2. About the Service
ASMI.AI is the Autonomous Social Media Intel-engine for political campaigns, operated by Ashayam Group (“Ashayam”, “we”, “our”), a company registered in India with its registered office at 12-13-336/1, Lane No. 6, Street No. 2, Tarnaka, Hyderabad – 500017, Telangana, India. The Service provides political intelligence including ward briefings, smart alerts, conversational AI replies, poster generation, and a dashboard for ward analytics across the Greater Hyderabad Municipal Corporation (GHMC) area.
3. Eligibility
You must be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872. The Service is intended for political campaign professionals, elected representatives, and authorised members of their teams. By using the Service you represent that you meet these eligibility requirements.
4. Account and access
The Service operates on a whitelist basis. Access is granted only after we agree on scope with the campaign or organisation you represent. You are responsible for:
- Keeping your authentication credentials (WhatsApp number, dashboard password) confidential
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use at ashish@asmi.live
We may suspend or terminate access at our sole discretion if we have reasonable cause to believe you or your team has breached these Terms or engaged in unlawful activity.
5. Acceptable use
You agree not to:
- Use the Service to incite violence, hatred, or discrimination on the basis of religion, caste, gender, sexual orientation, or any other protected characteristic
- Generate or disseminate disinformation, deepfakes, or content intended to mislead voters about polling logistics, candidate identity, or electoral outcomes
- Use the Service in violation of the Representation of the People Act, 1951, the Model Code of Conduct issued by the Election Commission of India, or any other applicable election law
- Harass, intimidate, or threaten any individual through the Service
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Resell, sublicense, or redistribute the Service or its outputs without our written consent
- Use the Service to scrape or extract data from third parties in violation of their terms or applicable law
- Impersonate another person or entity, or misrepresent your affiliation with any campaign or organisation
6. Intellectual property
All intellectual property rights in the Service, including the ASMI.AI brand, software, AI models we operate, ward enrichment data, and the structure of the dashboard, are owned by Ashayam Group or our licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for the duration and purpose agreed.
Outputs generated by the Service for your account (briefings, posters, summaries) may be used by you for your campaign’s lawful internal and external communications. We retain the right to use de-identified aggregate outputs for service improvement.
7. Third-party services
The Service relies on third-party providers including Meta WhatsApp Business Cloud API, Google Cloud Platform, Anthropic, OpenAI, Perplexity, and Cloudflare. Their respective terms and policies apply to the parts of the Service they enable. We are not responsible for outages, data handling, or policy changes of these third parties beyond our reasonable control.
8. AI-generated content disclaimer
The Service uses large language models and other AI systems to generate briefings, replies, and summaries. AI outputs may contain errors, omissions, or fabrications (“hallucinations”). You are responsible for verifying any AI-generated content before relying on it for material campaign decisions, public statements, or legal communications. Ashayam Group makes no warranty as to the accuracy, completeness, or fitness for purpose of AI-generated content.
9. Service availability
We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, third-party outages, or causes beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of data. Use of the Service is at your own risk.
11. Limitation of liability
To the maximum extent permitted by law, Ashayam Group’s aggregate liability arising out of or related to the Service in any twelve-month period is limited to the greater of (a) the fees actually paid by you to Ashayam Group in that period, or (b) ₹10,000. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
12. Indemnity
You agree to indemnify, defend, and hold harmless Ashayam Group, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service, or content you submit to or generate through the Service.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access at our discretion, with or without notice, if you breach these Terms or applicable law. On termination, the licenses granted to you cease, and obligations that by their nature survive termination (Sections 6, 8, 10, 11, 12, 14, 15) continue.
14. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts at Hyderabad, Telangana, India.
Before initiating legal proceedings, the parties agree to make a good-faith attempt to resolve disputes through written correspondence directed to our Grievance Officer at grievance@asmi.live for at least 30 days.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service (in-WhatsApp notice, dashboard banner, or email to registered users) at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
16. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy and any signed scope-of-engagement documents, constitute the entire agreement between you and Ashayam Group regarding the Service.
